Some App features may ask you to provide information, such as documents you upload, content you create within the App, or settings and preferences. Where possible, this information is stored locally on your device and is not transmitted to us.Purchase and Subscription Information. When you purchase a subscription or in-app purchase, the transaction is processed by Apple. We receive transaction details from Apple (such as product purchased, purchase date, subscription status, and an anonymous account identifier) but do not receive or store your payment card information.Diagnostic and Usage Data. If the App encounters an error, we may collect diagnostic information through third-party tools, including your device's IP address, device model, operating system version, App version, App configuration at the time of the error, and the date and time of the event. We use this information to identify and fix problems.Refund Consumption Data. If you submit a refund request to Apple for an in-app purchase, we may share consumption data with Apple to help process your request. This may include: the time elapsed since installation, total time spent using the App, an anonymous account identifier, whether the purchase was fully used, whether it included a trial period, the total amount spent, and the total amount previously refunded.## How We Use InformationWe use the information described above to:- Provide, operate, and maintain the Apps
- Process subscriptions and in-app purchases
- Diagnose technical issues and improve App performance
- Respond to support requests
- Detect and prevent fraud or abuse
- Comply with legal obligations## How Information Is SharedWe do not sell your personal information. We share information only with the service providers and third parties listed below, and only as needed to operate the Apps:- Apple. Processes all subscriptions, in-app purchases, and App Store transactions. Apple's privacy practices are described at apple.com/legal/privacy.
- Adapty. Provides subscription analytics, paywall management, and subscription event processing. Adapty processes subscription transaction data and an anonymous user identifier on our behalf.
- Diagnostic and crash reporting providers. May process device and error data when the App crashes or encounters an error.
- Legal compliance. We may disclose information if required by law, subpoena, or other legal process, or to protect the rights, property, or safety of Digital Gully, our users, or others.We may also share aggregated or de-identified information that cannot reasonably be used to identify you.## Data Storage and RetentionWhere possible, content you create or upload in the Apps is stored locally on your device. Transaction and diagnostic data processed through our service providers is retained only as long as needed for the purposes described above or as required by law.## SecurityWe use commercially reasonable measures to protect information processed in connection with the Apps. However, no method of transmission over the internet or electronic storage is completely secure. We cannot guarantee absolute security.## Your ChoicesSubscriptions. You can manage or cancel your subscription at any time in the Settings app on your device under your Apple ID > Subscriptions.Diagnostic data. You can limit diagnostic sharing in your device's iOS Settings under Privacy & Security > Analytics & Improvements.Account deletion. By downloading, installing, or using any App, you agree to be bound by these Terms. If you are under the age of majority in your jurisdiction, you must have permission from a parent or legal guardian. By using the Apps, you represent and warrant that you meet these requirements.## LicenseSubject to your compliance with these Terms, Digital Gully grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Apps on Apple devices you own or control, solely for your personal, non-commercial use, unless otherwise specified in the App.You may not:- Copy, modify, adapt, translate, or create derivative works of the Apps
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Apps
- Rent, lease, sublicense, sell, or otherwise transfer the Apps to any third party
- Remove or alter any proprietary notices, labels, or marks
- Use the Apps in any unlawful manner or in violation of these TermsAll trademarks, copyrights, database rights, and other intellectual property rights in and to the Apps remain the property of Digital Gully or its licensors.## Subscriptions and In-App PurchasesSome Apps offer subscriptions or in-app purchases. The following terms apply:- Payment. All purchases are processed by Apple and charged to your Apple ID account at confirmation of purchase.
- Auto-renewal. Subscriptions automatically renew at the end of each billing period unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the cost of the chosen subscription.
- Managing subscriptions. You can manage your subscription and turn off auto-renewal at any time in the Settings app on your device under your Apple ID > Subscriptions.
- Free trials. If a free trial is offered, any unused portion of the trial is forfeited when you purchase a subscription.
- Refunds. All refund requests are handled by Apple in accordance with Apple's policies. If you submit a refund request, we may share consumption data with Apple as described in our Privacy Policy.Prices and available products may change. Material changes will be communicated within the App or via the App Store listing before they take effect.## Personal Data and Device SecuritySome Apps may store or process information you provide in order to deliver their services. You are responsible for keeping your device secure and preventing unauthorized access. Jailbreaking or rooting your device may compromise the security and functionality of the Apps and is at your own risk. Our handling of personal information is described in our Privacy Policy.## Internet and Device RequirementsSome App features require an active internet connection. You are responsible for any data, roaming, or carrier charges incurred while using the Apps. If you are not the bill payer for the device you use, you must have permission from the bill payer. The Apps depend on your device being powered, updated, and operational. We are not responsible for issues caused by device failure, low battery, outdated operating systems, or user error.## Third-Party Content and ServicesThe Apps may incorporate or link to content, services, or libraries provided by third parties. We do not control and are not responsible for the accuracy, completeness, or availability of third-party content or services, and we accept no liability for losses arising from your reliance on them.## App Updates and AvailabilityWe may release updates to the Apps from time to time to add features, fix issues, or comply with new system requirements. We may also discontinue or modify any App, in whole or in part, at any time. There is no obligation to maintain or support any App indefinitely. We are not liable for any inability to access an App due to discontinuation, technical issues, or other circumstances.## TerminationWe may suspend or terminate your access to any App at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, all rights granted to you under these Terms cease, and you must stop using and delete the Apps.## Disclaimer of WarrantiesTHE APPS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, DIGITAL GULLY DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APPS WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.## Limitation of LiabilityTO THE FULLEST EXTENT PERMITTED BY LAW, DIGITAL GULLY AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE APPS. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE APPS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID DIGITAL GULLY IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) USD $50.Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages. In those jurisdictions, the above limitations apply to the maximum extent permitted by law.## IndemnificationYou agree to indemnify and hold Digital Gully harmless from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Apps or your violation of these Terms.## Governing Law and DisputesThese Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. Any dispute arising out of or related to these Terms or the Apps will be resolved exclusively in the state or federal courts located in Harris County, Texas, and you consent to personal jurisdiction in those courts.## Apple App StoreThe Apps are distributed through the Apple App Store. Apple is not a party to these Terms and has no obligations with respect to the Apps. To the extent these Terms conflict with Apple's standard Licensed Application End User License Agreement, Apple's EULA governs solely with respect to Apple's rights and obligations as a third-party beneficiary.## Changes to These TermsWe may update these Terms from time to time. When we do, we will update the "Last updated" date above and post the revised Terms on this page. Your continued use of the Apps after changes are posted constitutes acceptance of the revised Terms.

On your iPhone or iPad: open Settings, tap your name, tap Subscriptions, select eSign, then tap Cancel Subscription. Your access continues until the end of your current billing period.## How does the free trial work?The monthly and annual plans include a 3-day free trial. You won't be charged during the trial. If you don't cancel at least 24 hours before it ends, your subscription begins automatically at the plan price.## How do I restore a purchase?If you've subscribed before, open eSign and tap "Restore Purchases" on the subscription screen. Your subscription will be restored as long as you're signed in with the same Apple Account.## Is my data private?Yes. eSign processes all documents entirely on your device. Your files are never uploaded, stored in the cloud, or shared with third parties.## How do I request a refund?Refunds are handled by Apple. Visit reportaproblem.apple.com, sign in with your Apple Account, find your eSign purchase, and follow the steps to request a refund.
